For the Record: His first day in court, Kavanaugh asked questions of both sides in arguments over increased prison sentences for repeat offenders. He jumped in with his first question after most of the other justices had spoken.
Legal mumbo jumbo: Challenges to the law, which enhances penalties in illegal firearms cases based on previous convictions, have returned over and over to the Supreme Court as the justices are asked which types of previous convictions should count. In this case, the issue turned on whether a Florida robbery statute would call for an enhanced sentence.
Kavanaugh's exact Quote: "So why don’t we follow what Curtis Johnson seemed to do in applying those general statements to the specific statute at issue here, and why wouldn’t that then encompass the Florida statute, which requires more than, say, a tap on the shoulder?"
Really, he's wondering if they're really going to hold the defendant(s) to laws that are too sensitive. The answer, yes, there are times when touching someone in any way can be seen as a threat. Senators have lost their jobs for touching people just a little too suggestively. Supreme Court Judges according to Trump can TOUCH ANYONE ANY DAMN WAY THEY PLEASE!
